What Is Constructive Total Loss and How It Differs from Total Loss?

The insurance inspector takes many photos of your car at the garage and estimates that repairs will cost ₹4.6 lakh. Even if your car looks okay and is still standing on its wheels, the car insurance company considers it a total loss because the repairs are too expensive.

Even if your car isn’t stolen or destroyed by fire, it can be called a ‘constructive total loss’ if the repair costs are more than the car’s official value.

Many car owners lose money by arguing over the wrong details. Don’t waste time debating whether your car is truly a “total loss.” Instead, focus on the “Insured Declared Value” (IDV) on your policy, as that is the number that determines your payout. Below, in the blog, we explain how that value is set, how your payment is calculated, and what you are agreeing to when you sign the settlement.

Why Your Insured Declared Value Sets the Line

The Insured Declared Value (IDV) is the agreed-upon value of your car for the year. This amount is the maximum your car insurance company will pay you for damages.

IDV is not a guess. Insurers start from the manufacturer’s listed price and apply a fixed depreciation table used across the industry. Cars aged between one and two years are written down by 20%, ones between three and four years by 40%, and anything past five years is settled by agreement between you and the insurer.

Now, you know which value your repair estimate of ₹4.6 lakh is compared against.

What Is Constructive Total Loss in Simple Words?

Standard motor policy with the IRDAI treats a vehicle as a constructive total loss when the combined cost of retrieving and repairing it crosses 75% of the IDV.

The repair in this case is possible, but it just stops making sense because the price is quite high.

For example, the value on your schedule is ₹5.5 lakh, three-quarters, or 75% of that, comes to ₹4.12 lakh, and the garage estimate has already gone past it. The towing charges are also counted into the same total, which is why a car pulled out of a flooded basement crosses the line faster than any of its visible damage can show.

Where Total Loss and Constructive Total Loss Differ

A total loss means the vehicle is gone or beyond saving. It can include being stolen and untraced, burnt out, or washed away. So there is little left to assess here.

A ‘constructive total loss’ means your car could technically be fixed, but it isn’t worth the cost. Unlike a stolen car claim where you prove the car is missing, here you are arguing over repair costs. The inspector’s report is the most important part of your claim, so always ask for it in writing. You have the right to question the specific parts and labour costs in their estimate before you accept a settlement.

If you have extra coverage like Eco Assure, it helps cover the cost of using refurbished parts and removes depreciation. This can lower the repair estimate enough to keep your car repairable instead of it being declared a total loss.

What Actually Reaches Your Bank Account

Depreciation stops mattering once the declaration is made. Your policy treats IDV as market value for the whole year, with no further cut for a total loss or constructive total loss claim, so settlement starts at the full figure.

Your final payout is calculated by subtracting two specific amounts from the total. The first is the “compulsory excess” listed in your policy. The second is the estimated value of the wreckage, which only applies if you choose to keep the damaged car.

If you hand the salvage over to the insurer, you will receive the full IDV minus the compulsory excess. However, if you decide to keep the car, the insurer will also deduct the salvage value from your payment.

If you have an unpaid car loan, the insurance company will pay off the bank first. Also, you will lose your ‘No Claim Bonus’ discount, which means you have to start from zero when you insure your next car.

The Paperwork Nobody Warns You About

Signing the settlement is not your last step. Registration of a written-off vehicle has to be cancelled with the RTO, and the car insurance on it ends at the same time, which your insurer reports to the transport authority.

If you don’t cancel your car’s registration, the government will still treat it as an active vehicle, which means you might keep getting challans. Also, leaving the registration active is risky because it allows wrecked cars to be repaired and sold illegally to new buyers with paperwork that appears valid.

What the Rule Gets Right and Where It Hurts

The 75% rule is a blunt line. As older cars have a lower IDV, even minor damage can force the car insurance company to label the car a “total loss” and pay you out, even if you were happy driving it.

The same rule is good because it removes any uncertainty. This rule prevents you from having to fix a car that may never drive properly again, because the payout limit was already set when you bought your policy.
